Benjamin Law Firm Celebrates Acquittal in High-Profile Defense Case

|

El Paso, Texas – The Benjamin Law Firm announced today the successful defense and subsequent acquittal of Ms. Clevy Muchette Nelson Royster, a former Army captain stationed at Ft. Bliss. After a prolonged and intense trial, Ms. Nelson-Royster was found not guilty of all charges relating to the death of U.S. Army Captain Malcolm Perry on October 11, 2020.

The case, which captured widespread attention, concluded on February 29, 2024, when a jury acquitted Ms. Nelson Royster of murder, manslaughter, and aggravated assault with a deadly weapon.

The defense, led by Brock Benjamin of the Benjamin Law Firm and co-counseled by El Paso attorney Louis Lopez, highlighted the lack of conclusive evidence linking Ms. Nelson-Royster to the alleged crimes.

”Our defense centered around the fact that the prosecution’s narrative was not supported by concrete evidence,” Benjamin told reporters. “It was imperative to demonstrate that circumstantial evidence and speculation could not decide a case with such serious implications.”

Ms. Nelson-Royster, who had an intermittent five-year relationship with the deceased, expressed overwhelming relief and gratitude upon hearing the verdict. Her defense team argued that although there were disputes between the couple, there was no intent or action on her part leading to Capt. Perry’s tragic death.

The emotional toll of this process has been immense, and Ms. Nelson Royster is now focusing on rebuilding her life, including seeking employment opportunities on the East Coast.

The Benjamin Law Firm remains committed to upholding the principles of justice and fair representation. This case reinforces the significance of thorough legal criminal defense and the necessity of evidence-based prosecution in our legal system.
